Research Use Policy

1. Scope

This policy governs every material supplied by NuuVive, operated by H2Op Brands, Inc. (“NuuVive”, “we”, “us”). It applies to every order, every account and every visit to this site. It is incorporated in full into the Terms of Sale and Use, and it prevails over any other description of our products anywhere on this site or in any communication from us.

All products supplied by NuuVive are supplied strictly for laboratory research use. They are not supplied for use in humans or animals, and may not be resold, labeled, or represented for any such use.

2. Permitted use

Materials are supplied solely for laboratory research, analytical and in-vitro use by a purchaser qualified to handle them. They are supplied to be studied, not used.

3. Prohibited use

Materials supplied by NuuVive are:

• not to be used, consumed, ingested, or otherwise by any human, and not to be administered to any animal;
• not intended to be combined, mixed, or otherwise adulterated for purposes of consumption or administration to any human or animal, whether by the purchaser or by any third party;
• not to be resold, relabeled, repackaged, transferred or represented, by any person, for any use prohibited by this policy;
• not to be used in any food, beverage, cosmetic, supplement, compounded preparation or other product intended for a human or an animal.

We publish no dosage, administration, reconstitution, protocol or therapeutic guidance, and we will not supply any on request. No statement on this site should be read as describing an effect in a human or an animal.

We do not publish protocols, handling procedures or suggested applications. Determining suitability for a given experimental design is the responsibility of the qualified researcher.

4. What NuuVive is not

NuuVive products are sold by H2Op Brands, Inc., a distributor of research materials. H2Op Brands, Inc. is not a compounding pharmacy or chemical compounding facility as defined under 503A of the Federal Food, Drug, and Cosmetic Act. H2Op Brands, Inc. is not an outsourcing facility as defined under 503B.

NuuVive is not a compounding pharmacy or chemical compounding facility as defined under section 503A of the Federal Food, Drug, and Cosmetic Act. We do not compound, dispense or fill prescriptions, we do not operate under the supervision of a licensed prescriber, and we do not supply to patients.

NuuVive does not provide medical, veterinary, pharmaceutical or scientific advice, and nothing on this site is an offer to do so.

5. Purchaser representations

By placing an order you represent, on your own behalf and on behalf of any organization you order for, that:

1. you are at least 21 years of age;
2. you are acquiring the material for laboratory research use only, and you are qualified to handle, store and dispose of it safely;
3. you will not use the material, or permit it to be used, in any way prohibited by section 3;
4. you will not transfer the material to any person who has not agreed to these same restrictions.

You confirm these representations twice: once at the age acknowledgment on entry, and again through an explicit, non pre-checked acknowledgment at checkout. We store the exact wording you agreed to, together with the time you agreed to it, against the order.

6. Enforcement

This section states what we do, not what we hope customers will do.

If a customer states, implies, requests or asks about human or animal use — in an order note, an email, a support ticket, a review, a message on any channel we operate, or in any other communication with us — we will:

• cancel the order, and refund it in full if it has not yet shipped;
• close the customer’s account permanently and refuse all future orders from that person, payment instrument, address or household;
• retain a record of the communication and of the action taken, for the period required by section 5 of our Privacy Policy.

We do not require evidence that the material was actually used. The statement alone is sufficient. We apply this consistently, we do not negotiate it, and there is no appeal. Refunds in this situation follow the Refunds & Returns Policy, which is the only place refund terms are stated.

We also cancel orders, without further explanation, where an order, address or payment pattern indicates that the material is being acquired for a prohibited use.

7. Your responsibility under local law

You are solely responsible for determining whether your purchase, import, receipt, possession, handling, storage, use and disposal of a material is lawful where you are, and for obtaining any license, registration, institutional approval or permit that applies to you. We do not advise on this and cannot assess it for you.

We may decline or cancel any order, at any time and for any reason, including where we believe a shipment would be unlawful at its destination.
